These Terms of Service ("Terms") govern your use of this website and your purchases from Kitchi, a brand operated by Çomoğlu LLC ("Kitchi", "we", "us"), 3979 Albany Post Rd 2062, Hyde Park, NY 12538, United States. By using the site or placing an order you agree to these Terms. If you don't agree, please don't use the site.

1. Using the site

You may use the site for lawful, personal shopping. Don't misuse it, interfere with its operation, try to gain unauthorized access, or use it for any purpose that violates U.S. law. You must be at least 18, or have a parent or guardian's permission, to place an order.

2. Products and descriptions

We try to describe and photograph our products accurately. Colors can look different on different screens, and cooking results vary with your stove, heat and technique. Product information is provided for general guidance.

3. Orders and acceptance

Placing an order is an offer to buy. We may accept or decline any order, for example because of product availability, a pricing error, a suspected fraudulent order or an address we cannot ship to. If we cancel an order after you have paid, we will refund you in full.

4. Prices, discounts and pricing errors

All prices are in U.S. dollars. Sales tax is calculated at checkout where required. Discounts and promotional codes apply as described when they are offered; they can't be combined unless stated, and we may end a promotion at any time. If a product is listed at an incorrect price because of an obvious error, we may cancel the order and refund you in full, or contact you to confirm the correct price before shipping.

5. Payment

Payment is processed securely by Shopify and its payment partners. We don't store your full card details. You confirm that you are authorized to use the payment method you provide.

6. Shipping and delivery

Shipping terms, delivery times and the areas we ship to are described in our Shipping Policy. Delivery dates are estimates and not guarantees.

7. 90-day trial, returns and refunds

Our 90-day trial and return terms are described in our Refund Policy, which is part of these Terms.

8. Warranty

Kitchi cookware carries a 10-year limited warranty against manufacturing defects, as described on our Warranty page. The warranty doesn't cover normal wear, discoloration, misuse or commercial use.

9. Intellectual property

The Kitchi name, logo, product designs, photographs, text and other content on this site belong to Kitchi or its licensors and are protected by law. You may not copy, reproduce or use them for commercial purposes without our written permission.

10. Disclaimer and limitation of liability

To the fullest extent permitted by law, the site and its content are provided "as is" and "as available", and we disclaim all warranties not expressly stated in these Terms or in our written warranty. Kitchi will not be liable for indirect, incidental, special or consequential damages arising from your use of the site or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits rights you have under applicable law that cannot be waived.

11. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. If you have a concern, please contact us first so we can try to resolve it informally. If we can't, any dispute will be brought in the state or federal courts located in New York, and you and Kitchi consent to their jurisdiction.
